Terms and Conditions of Sale and Delivery

The following terms and conditions of sale and delivery apply to all Winebutler.be offers and VOF Bom Bini offers. The conditions are available for anyone to consult and are also included on our home page. We will send you a written copy on request.

Acceptance of sales terms

The contract between VOF Bom Bini and the customer shall be concluded with the acceptance of the order by VOF Bom Bini. The acceptance is automatic, unless otherwise communicated to the client. By placing an order in the manner provided, the customer declares to have read the information provided during the purchase procedure and accept the terms transcribed below. Therefore the Customer is warmly invited to read these conditions of sale and to print them or save them in another durable medium accessible to him.

  1. Prices

All prices are in Euro, inclusive of VAT and exclusive of delivery costs, unless stated otherwise.

  1. Price changes

VOF Bom Bini reserves the right to change prices and correct any errors at any time. If a price change has an effect on the order(s) you have placed, you have the right to cancel them without any charge.

  1. Availability

All VOF Bom Bini offers are without obligation and subject to availability. We will inform you if, unexpectedly, a product is no longer available and may suggest an alternative. We will contact you by e-mail.

  1.  Age

Alcoholic beverages may only be sold to people who are 18 or older. We can only sell wine to adults.

  1. Foreign orders

VOF Bom Bini, a Belgian company, is subject to Belgian law, regulations and procedures. If the recipient of our products is not located in the country from which they are dispatched, the recipient is liable for any sales tax or import duty in the destination country.

  1. Payment

VOF Bom Bini only delivers after payment has been received in advance via our pay page. Payment upon receipt of invoice is possible for our established customers.

  1. Deliveries

The delivery times provided on the website and in the order confirmation are purely indicative and do not constitute an exact deadline. VOF Bom Bini cannot be held liable at any time for any damage resulting from delivery times being exceeded.

  1. Transport

All our prices are exclusive of transport and insurance costs. VOF Bom Bini partners with Bpost for all deliveries.

  1. Complaints

If, on receipt, you notice that the delivered product does not correspond to your order, you can contact us directly by e-mail (info@winebutler.be) or by Facebook (winebutler.be). Your complaint will then be handled accordingly.

  1. Guarantee

What guarantee do I have if the wine I buy is bad or cork tainted? As we trade in old and exclusive wine, it is not possible for us to offer any form of guarantee – we always strive to supply products of the highest possible quality – however it is impossible for us to offer any guarantee for wine older than 5 years.

With regard to cork tainted wine, as this happens during the bottling process we cannot revert to the producer and it is also impossible for us to offer any guarantee for such cases.

  1. Cancellations

You may change or cancel your online order within 14 days of placing it, without providing a reason for doing so. However, this does not apply to the perishable products that we supply. If in the meantime the order arrived at the client’s home or address, the client is responsible for returning the product to us, the cost of return is accounted for by the client.

  1. Personal data

VOF Bom Bini guarantees that your personal details and information will be handled with the strictest confidence and will not be made available to third parties. More information can be found on our Privacy & Cookies page.

  1. Disputes

In the event of a dispute, the Court of Oudenaarde shall be the sole competent court. The amount of any potential damages can never exceed the value of the ordered and delivered goods. All disputes are subject to the exclusive jurisdiction of the courts of Oudenaarde.
